sent to the governor for his review Under the Kansas Constitution Stephan says the Legislature can make a valid law only by passing a bill and sending it to the rules and regulations including one which exempts several hundred small grain elevators in Kansas from a requirement for air pollution inspections and fees Stephan contends that a legislative change in an administrative rule is in effect making law He Council a group of eight legislative leaders and the governor could not reject approve or modify the proposed rules and regulations of the Department of Administration The 1984 Legislature adopted li resolutions to alter administrative and regulations He also says the Kansas Supreme Court concluded in a 1976 decision that adoption of regulations is a function of the TOPEKA Citing court decisions from other states and a 1976 Kansas case Attorney General Bob Stephan's office has called for the state Supreme Court to declare unconstitutional a legislative practice of revoking and changing regulations of government agencies Stephan contends that the legislative veto of state agency regulations is a violation of the constitutional doctrine of separation of powers and represents an unlawful method of enact-StePhan ing a law The intent of the Legislature is to "establish Us superiority over the executive department in this essentially executive area" Stephan says in briefs outlining his legal arguments in the case Stephan filed the lawsuit nearly two weeks ago challenging the Legislature's regulation oversight practice In it he urges the court to invalidate any enactments changing agency rules or regulations Named as defendants are legislative leaders and Gov John Carlin The defendants are to file briefs with the court by the end of next week to explain their position in Stephan: No Party Races For Patrol PATROL From 1C fund-raising or campaigning at a rally Stackhouse a trooper since 1974 said he thought that the state statute in question could be challenged as unconstitutional because at first reading it prohibited any political activity by a trooper BUT BECAUSE Stephan clarified that troopers can engage in some political activities to interpret the law that bans "participation in politics" Stephan turned to West Virginia where a similar state law considered overly broad and vague was challenged IN THE West Virginia case a court decided the law should be interpreted to prohibit: Holding a party office Working at the polls Organizing a political party or club Actively participating in fundraising activities for a partisan candidate or political party Becoming a partisan candidate for or campaigning for an elective public office Actively managing the campaign of a partisan candidate for public office Initiating or circulating a partisan nominating petition or soliciting votes for a partisan candidate for public office Serving as a delegate alternate or a proxy to a political party convention Based on those specific guidelines Stephan told Cantwell no trooper can be a partisan candidate for political office even if they take a leave of absence without pay prior to filing Tor office with the understanding
