under changing conditions Kreoinineiid Dial System The rate reduction ordinance recalled that the action followed full and fair hearing concerning local exchange telephone and that the Council concluded charges should be reduced "after consideration of evidence exhibits briefs and of both the City and the utility The Council adopted in connection with the ordinance a resolution recommending that the Mountain States be compelled to install a dial telephone system in El Paso as soon as equipment for the change-over from the present manual system can be obtained The resolution said the Council believes a dial system would improve service and result in company operating and maintenance cost savings which could be passed on to the customers still allowing the utility a fair profit on its investment Ask Franchise Provision The Council recommended that If and when a new franchise is granted Mountain States within the City it contain a provision compelling the changeover to dial telephones The telephone company's franchise to use City streets and alleys for its poles and lines expired Oct 25 1932 and never has been renewed The resolution contended that Mountain States should have installed a dial system before the present emergency made it impossible to do so During the hearing Cyrus Hill City utility rate engineer presented a study which showed that Mountain States could save $75000 a year by installing a dial system Company officials called Mr Hill's study fantastic Mayor Anderson ordered the resolution spread upon the Council minutes as a permanent record which succeeding Councils might want to study The Council based the reduction ordinance on findings which grew out of the rate hearing Filed with the ordinance the findings stated in part that: Findings Given 1 A fair value of Mountain States properties within the City limits based on prices of last Sept 30 was $1400000 (Mountain valuation was about $500 000 higher than this Utility rates rise in proportion to the increase in valuation or investment after operating costs and earnings are taken into consideration) 2 A depreciation reserve of $63 496 a year to replace worn out equipment on that part of the plant within the City is a fair figure and can be apportioned to operating expenses iThe annual depreciation reserve figure was approximately $20000 more than the Council's estimate) 3 The Council rejected the contention that l'S per cent of Mountain States gross revenues each year should go to the parent American Telephone Telegraph Co under a license contract agreement through which A Si performs legal engineering and other services for the El Faso subsidiary (During the hearing City experts contended the flat per cent payment tended to be excessive and was listed as an operating cost They said Mountain States should pay A St tor actual services rendered instead of an arbitrary rate) 4 A fair rate of return or profit for Mountain States on its invest ment within the City is 525 per cent annually (City experts testi fied that Mountain States' rate of return has run as high as 8 per cent) 5 The reduced rates which be-cjtre effective June 11 still will ield to Mountain States more than a fair rate of return upon the entire El Paso exchange and upon that part of the plant located within the City Fhone Firm Attorneys Confer On Action Attorneys for the Mountain States Telephone and Telegraph Co said today they will conlcr with Mountain States officials at the Denver home office before deciding whether to contest the City telephone rate reduction ordinance One utility attorney said the ordinance creates a question of involving the right to revise rates charged City telephone customers who use their phones for calls beyond the City limits the present charges it must make available for customers facilities outside the City so El Pasoans can make calls to the Upper and Lower the attorney said question which must be answered is whether the City legally can compel the company to render service outside the City for the reduced rate which it set inside the Copies of the rate reduction ordinance will be sent to Denver so its affect on the revenues can bo Axis U-boat as they attempted to escape from their torpedoed sinking American merchantman in the Caribbean May 12 survivors reported today Crewmen from another American merchantman sunk in the same area May 25 told how German U-boat sailors shouted and clapped their hands when given a false figure on the torpedoed tonnage The crew of 35 was saved The story of the machine-gunning of the four Americans was told by Charles Parrish of Washington second Assistant engineer of the medium-sized vessel sighted the submarine astern of us about 9:20 he said tried to outrun her but it was useless for she overtook us after about 20 minutes As she came within range they opened up with shell and machine-gun fire did not have a gun aboard and we started to abandon ship We cut away the lifeboats and rafts and some of the crew made the descent by ladder Two officers were shot from the ladder by machine-gun fire continued to fire even after we were in the lifeboats and another officer was drilled through the head with bullet The rest of us crouched in the lifeboats as bullets tore into the tiny craft The lifeboat was so badly riddled that we were forced to abandon it and board Round after round of shellfire failed to sink the vessel the crewmen said and the U-boat finally fired a torpedo into her port side For four days the lifeboat with the 17 survivors sailed and drifted about the Caribbean before it was taken in tow by a native sloop and towed into Bon Air a small island near Curacao A tanker later brought six of the men to Key West Still missing were eight other crewmen
