Murphy of Del Norte in the Chair The Committee on Rules reported recommending thu adoption of a committee on nil and Homestead Exemption to consist of 9 members recommending that the resolution asking for a special Committee on Judicial System be not passed and that the name of the present committee be the Committee 011 Judiciary aud Judicial Department Also that the resolution to have each committee appoint a Secretary from among its own members be furred to the Committee on Mileago aud Contingent Expenses Report of committee adopted RULES ADOPTED The rules offmed by the special com-mitleo were read amended and are in process of adoption seriatim The Convention shall meet at 10 every day and take a recess from 12 to 1 AU committees shall be appointed by the President unless tho Convention otherwise specially directs No poraon allowed 011 tho floor except offioers attaches and reporters unless by special invitation of the Convention or the President No membor outsido of the bar of the House allowed to vote No committee shall sit while tho Convention is in session without leave No member shall receive pay for any week day ou which ho has not actually attended the auy other purpose during tho session No increase of pay shall be allowed to any officer of the Convontiyn except by unanimous consent Fivu hundred copies of each proposition or resolution embodying matter pioposed to bo iutroduoed into the Convention shall be printed Other rules are tho usual parliamentary rules Discussion of this subject and amendment took the entire forenoon aud then they were not one-half through when a recesss was taken until 1 San Francisco Oct 8 Jennings Cox the former business partner of the late Alex Austin was cited to app- ar before the Probate Court this morning and answer regarding the property of the late Austin supposed to he in his possession and show cause why he should not sunender the samo to the Public Administrator Neither Cox nor his counsel iippi ared in answer to tho citation and tbe case was continued until tomorrow The citatit is due to the pos session by Cox of letters from Ellio Wil-tou and tier sister Mrs Bogart Iu the meantime the letters have been obtained under writ of replevin There are 17 of them and they are now locked up iu the safe Tho friends of Miss Wil-the ton admit that Austin undoubtedly made her presents of money election of a delegate to fill the vacaucy caused by tlie resignation of Thomas Morris of Sun Francisco having arn ed Judge Ilagar withdrew the name of Judgo Burch aud was followtd by Col Barnes who withdrew the name of Reuben II Lloyd llrmvn of arose to explain how lie should vote Ho thought that tlie man to fill a vacant position should be iu accord with the views of Ihe people whom he would the claims of tho Alameda delegation were entitled to any consideration and he therefore nominated Thom Reynolds of San Francisco nominated noble friend of the people and uncompromising foe of etc Tho vote stood 87 for Martin and 3 for Thom the votis bi ing with the exception of these scattering Martin was called for to take the oath hut it appears he left town this morning ou business ELECTION OF STRONG For tho position made vacant by the death of Hardwick of Mariposa aud Merced Strong of Merced aud Lap-ham were nominated Strong received 107 and Lapham only 3 mauy of the members either not voting at all or casting scattering voles for Theodure Tilton dims Webb Howard Teter Donahue etc Mr Strong was brought btfore the bar of the House and Bworu in Adjourned till Monday at 1 Jury LIBEL SUIT Disagree and charged are Iis- Teu for Conviction Two for Acquittal By Telegraph to the Bee Flacerville Oct 5 The jury in the 8argent-Page-De Young libel suit came in this morning asking to be discharged and claiming that there was no possibility of an agreement The jury stands ten for conviction and two for acquittal The latter two favor acquittal on the ground that the prosecution had no right to bring action in El Dorado county The Court sent them in charge of an officer to breakfast and refused to discharge them until they had further deliberated LATER The jury
