(n) "Person" means an individual, firm, association, partnership, public or private corporation, company, organization, polibcal subdivision, governmental agency, trustee, receiver or any other entity whatsoever. (o) Recyclables" means solid waste, including, without limitation, aluminum, glass bottles and jars, paper, newspaper, cardboard, plastic containers, bn and bi-metal, white goods, yard or tree waste and other materials which can be processed and returned to the economic mainstream in the form of raw material for new, reused, or reconstituted products which meet the quality standards necessary to be used in the marketplace. (p) Solid waste" means all putrescible or non-putresable solid and semi-solid waste including recyclables, refuse, garbage, rubbish, trash, decaying vegetable and animal matter, ashes, street refuse, green waste, industrial waste, swill, offal, bn cans, paper, medical solid waste and other offensive or nauseous substances excepting the following: agncultural solid waste, and liquid-earned industrial wastes, and sewage or sewage hauled as an incidental part of a septic tank or cesspool cleaning service, medical waste, ana hazardous or toxic waste as defined and regulated by federal, state or local laws and regulations.

(q) Solid waste containers" means a regulation solid waste container or containers approved by the Solid Waste Superintendent. (r) Solid waste collection service" means service furnished by the City of Hanford or a duly permitted collector for the collection and disposal of solid waste within the City and the areas provided service by the City in the County of Kings and hauling said waste to a facility for processing, transfer and disposal (s) Solid Waste Processor means any person regulady engaged in the processing andor recycling of solid wastes. Solid Waste Processor includes a Buy-Back Facility. (t) Solid waste facility means a disposal site, buyback facility, material recovery facility (MRF), composting facility, transfer station, or a site that engages in any solid waste processing, or any facility specified in California Public Resources Code Section 40194 and as amended from time to time. Solid waste facility shall include a commercial or industrial business conducting salvage of recyclables, but shall exclude private residences engaged in salvaging of recyclables for their own purposes.

(u) Solid waste separation means the placement of recyclables in separate containers or bags, or the physical separation of recyclables from other solid waste. The term segregation shall be interchangeable with separation. (v) Solid Waste Superintendent" means the Public Works Director of the City or such person designated by him to supervise the solid waste collection and disposal service for the City (w) "Special haul" means the ollec collection of solid waste in ex cess of the maximum amounts of solid waste to be collected by the City at a single collection or any collection of any material not defined in this Section as solid waste. (x) Special waste" emans solid waste which has characteristics which make it unsuitable for collection andor processing by regular or routine methods Such wastes will be collected andor processed separately from the regular collection and procedures (y) Source separation' means the separation or segregation of solid waste, at the place of generation or production of the wastes and resources for separate collection. processing, recycling, reuse, recovery or disposal.

(z) 'Valk-in service" means service where one thirty-two (32) gallon solid waste con tamer may be placed for col lection not more than seventy-live (75) feet from the curb face. Such service shall be limned to customers who are blind, disabled, or, or some physical reason, cannot move their containers to the curb or alley Such hardship cases will be reviewed and a decision made on an individual basis by the Solid Waste Superintendent Sec. 6-3102. Solid waste collection service (a) All dwellings, apartment houses, and places of business in which solid waste accumulates within the City shall be required to use the solid waste collection service ol the City or a duly permitted collec- tor and to pay the charges set forth in this Chapter. (b) All persons using the City Solid Waste Collection Service or a duly permitted collector shall separate recycl ables from all other solid waste produced at their premises and dispose ol the same only in accordance with the procedures established by the City Council.

Such procedures shall require the placement of recyclables into different con tamers so as to facilitate segregation at a Solid Waste Facility. These procedures shall be established by resolu tion of the City Council which shall be amended from time to time as may be necessary to meet the requirements ol the Act. (c) Solid waste, when placed out in appropriate containers lor collecting shall be deemed under control of the City. Sec. 6-3 103.

Solid Waste Collection Service.Residen-tial. (a) Frequency and amount of collection. The City shall collect, twice each week, from all dwelling units in the City service area, one (1) or more sixty (60) or ninety (90) gallon automated solid waste containers approved by the Solid Waste Supenntendent. (b) Responsibilities of curb servioe customers: Resided tial All curb service customers shall place their solid waste containers at the curb not ear- tier than 7.00 m. on the day prior to collection and shall remove the empty containers from the curb not later than 12 00 midnight on the day of collection.

(c) Collection ol lawn dip-pmgs. trimmings andyard wale. Lawn dippings, trimmings and yard waste are recyclables and must be placed in separate waste bags or containers and then placed in the solid waste container with other solid waste for collection on regular collection days. Tree trimmings and limbs too numerous or large to be and January of each year. The report shall contain the follow- ing information: (1) The name, address and telephone number of the person, firm or corporation conducting the solid waste collection andor processing.

(2) City permit number. J3) The type of solid waste looted andor processed. (4) Total tonnage of solid waste collected or received for processing during that respective quarter. (5) Type of and tonnage of recyclables collected, received and processed. (6) Destination of processed recyclables.

(7) Destination for disposal of non-re cydable solid waste. (c) All permittees who dispose of non-recyclable solid waste must enter in an agreement with the KCWMA which shall provide that KCWMA will accept the solid waste collected andor processed by the permittee for the term of the permit and the permittee will deliver all such solid waste to KCWMA's designated facility. Receipt by the "City of an ex- agreement ecuted copy of sail shall be a condition precedent to the issuance of a permit. Sec. Permits: Ter-mination.

(a) Any permit issued pursuant to this Article shall terminate at the date of termination of the contract between the permittee and the person to whom it furnishes such special services or as otherwise specified in the permit. (b) The Solid Waste Superintendent shall have the right and authority to terminate any permit issued pursuant to this Article when: (1) In the judgment of the Solid Waste Superintendent, such services can be performed with the Citys regular equipment; or (2) In the judgment of the Solid Waste Superintendent, the disposal of such accumulations is interfenng with the City's disposal of solid waste in accordance with Article 1 of this Chapter; (3) The permittee fails to submit the quarterly Report of Solid Waste Processed' as provided in Section of this Article; (4) The permittee breaches any provision of the agreement with 0 the KCWMA. Sec. Permits: Termination1 Notices" Appeals (a) The Solid Waste Superintendent may terminate any permit issued pursuant to this Article on ninety (90) days' written notice to the permittee. The permit shall terminate on the ninetieth day from the date of said notice.

Such notice may be given in writing by ordinary mail, postage prepaid and addressed to the permittee at its last address as shown by the City's records. (b) Any permittee who has received a notice of termina tion may appeal the termina-tni tion to the City Council within ten (10) days of the date of said notice of termination. The appeal shall be in the form of a written notice filed with the City Clerk and signed by the permittee. The notice shall state clearly ane concisely the reasons upon which the appellant relies for his appeal. The City Clerk shall set tne matter for heanng before the City Council within thirty (30) days after the notice of appeal is filed, and shall notify the aj-pellant by certified mail, postage prepaid, return receipt requested, of the date of hearing at least ten (10) days before the heanng by the City Council.

At the nearing, the appellant shall have the burden of establishing to the satisfaction of the City Council that it is entitled to relief, or otherwise the termination shall stand. The determination of the City Council shall be final and conclusive upon the permittee. Sec. Permits not assignable Any permit issued pursuant to this Article shall be personal to the permittee and shall not be assignable. Any attempted assignment of such permit shall result in immediate termination of such permit.

Sec. 6-3 207. Business licenses required The holder of a permit issued pursuant to this Article, if it does not already hold a business license from the City reauired to apply for and hold a business license from the City pursuant to Chapter 1 of Title 3 of the Hanford Municipal Code during all times in which such permit is in effect, ARTICLE 3. MISCEL LANEOUS. Sec.

Court Proceedings. Any person who shall violate any of the provisions ot this Chapter shall be guilty of a misdemeanor, and upon conviction thereof, be punished by a fine of not more than five hundred dollars ($500 00) or by impnsonment for a period ol not to exceed six (6) months, or by both such fine and impnsonment. Sec. 6-3 302. Validity.

If any section, subsection, sentence, clause, word phrase ol this Chapter is held to be unconstitutional or otherwise invalid for any reason such decision shall not affect the validity of the remainder of this Chapter. Section. This ordinance shall take effect thirty (30) days after its passage and a summary of this ordinance shall be published within fifteen (15) days after adoption of this ordinance, together with the names of those City Coun cil Members voting for or against the ordinance and the City Clerk shall post in the office ol the City Clerk a certified copy fo the full text of this ordinance along with the names ol the City council Members voting for and against the ordinance within fifteen (15) day after adoption hereof. Chapter 3 of Title 6 of the Hanford Municipal Code is hereby replaced in its entirety as follows: ARTICLE SOLID WASTE COLLECTION AND DISPOSAL." Sec. Definitions. For the purpose of this Chapter, the following terms, words and phrases are defined as follows: (a) Act" means the California fntegraled Waste Management Act of 1989 (California Public Resources Code Section 40000 et sea and all regulations adopted under said Act, as may be amended from time to time. (b) Buy back facility means a facility which receives source separated malenals for a fee.

(c) "City" means the City of Hanford. (d) "Council" means the City Council of the City of Hanford. (e) "Collector" means any person who operates a service route or provides service and is directly or indirectly reimbursed for the collection, transportation, and disposal of solid waste from residential, commercial or industrial premises where generated in the City of Hanford. (f) Compost" means the product resulting from the controlled biological decomposition of organic wastes that are source separated from the municipal solid waste stream or which are separated at a centralized facility. (g) "Composting facility" means a permitted Solid Waste Facility at which composting is conducted and which produces compost, excluding private residences engaged in composting lor their own purposes.

(h) "Containerized service means service approved by the Solid Waste Superintendent wherein the City provides a vehicle equipped for the mechanical handling ol one two (2) or three (3) cubic yi containers with casters. Such ard containers shall be furnished by and rented from the City. (I) "Curbside collecting means the collection of solid waste from a location adjacent to the street or alleyway. (j) KCWMA" means the Kings County Waste Management Authority, a joint power agency consisting of the County of Kings and member cities. (k) "Landfill" means a disposal site at which solid waste is deposited and compacted before burial In a specially prepared area which provides for environmental monitoring and treatment.

Solid waste collection service fTlates: Set-bna by City" Council resolution: Charges for street sweeping and leaf pickup. All rates and charges for solid waste collection service for residential, commercial, and containenzed service shall be fixed by resolution of the City Council and may include a charge to each residential, commercial, and containerized service within the City limits for street sweeping and leaf pickup. Sec.

Solid waste collection service: Rilling. Solid waste collection charges shall be included on the regular City utility bill to customers who also receive City water service. When the solid waste customer does not receive City water service, a separate bill for solid waste service shall be mailed month-to the customer who owns or controls the premises serviced. Sec. Solidwaste collection seryiceTDelinquen- cies, (a) All charges for solid waste service included on utility bills shall be due and payable at the same time as other utility charges.

If a bill for solid waste service is not paid within the time provided, the City may discontinue water servioe to the premises. (b) All solid waste collection service bills, if not a part of the City utility bills, shall become delinquent fifteen (15) days after the date of mailing. If a bill for solid waste collection service is not paid within such time, the City may discontinue service Service shall not be restored until the bill is paid and a cash deposit is paid to ensure the payment of future bills. Sec. 6-3 1 07 Solid waste accumulations' Unlawful (a) Except for duly licensed solid weaste facilities, it shall be unlawful for any occupant or owner of any building, ot, or premises in the City to allow or permit to collect or remain on such premises any solid wate (b) All premises shall be kept free of solid waste and litter.

The owner, occupant or operator of any premises ahll be responsible for the safe and sanitary storage of all solid waste and recyclables accumulated on the premises Sec Burying or dumping solid waste (a) It shaT be unlawful for any person to bury, dump or permit to be buned or dumped any solid waste in any place within the City, and all solid waste in the City shall be palced in solid waste containers as defined in subsection (q) of Section of this Article. Sec. Enforcement of provisions. The Solid Waste Superintendent shall enforce the provisions of this Article and shall have the power to establish rules and regulations consistent with the provisions of this Article governing the keeping, collection, removal, and disposal of solid waste RTICLE 2 REFUSE ACCUMULATIONS; SPECIAL" SERVICES. Sec 6-3 201.

Purpose of Ar: tide The provisions of this Article are necessaty to protect the health, safety and welfare of the citizens of the City and to provide compliance with the Act. The provisions of this Ar-tide shall govern the following1 (a) The collection and disposal ol solid waste accumulations from construction and heavy commercial and industrial sites within the City, including, without limitation, the collection and disposal of rocks, concrete, brick, dirt, plaster and building materials and other solid waste accumulations of such quantity andor frequency as to be in excess of the normal capacity of the solid waste equipment used by the City's Refuse Division. (b) The collection, handling and processing of recyclable materials including recyclables from buy-back centers (c) The permitting, licensing and reporting requirements tor solid waste collectors and processors and solid waste facilities. Sec. 6-3 202.

Persons authorized. (a) Any person is hereby authorized to furnish by contract with the owner of any premises within the City, sub ject to the conditions, limitations, and provisions contained in this Article, special services for the handling and disposal of solid waste, including, without limitations, rocks, concrete, brick, dirt, plaster, and building matenals and other refuse accumulations of such quantity andor frequency as to be in excess of the normal capacity ot the solid waste e-quipment used by the City's Refuse Division. (b) Any person is hereby authorized to furnish by contract with the owner of any premises or business within the City, subject to the conditions, limitations and provisions contained in this Article special services for the collection, handling andor processing of recyclable materials. (c) Subject to the conditions, limitations and provisions contained in this Article, any person within the City may establish a properly located buy bock facility. Sec.

6-3 203. Permits: He-qjired, (a) Any person desiring to enter into a contract with the owner of any premises or bust ness within the City to provide special services for solid waste desenbed in this Article shall first apply lor and obtain a permit from the Solid Waste Superintendent In such form and containing such Information as shall be required by the Solid Waste Supenntendent.
