"Obviously, if you've got a serial killer coyote out there, you've got to take some action and that would be warranted," Almand said. "There's probably a very thin line between doing what's right and going overboard. We've got to stay on the right side." BLM policy requires annual predator control plans, the biologist said, to ensure that control is balanced and sound. For instance, some public lands are off limits to certain measures, like poisons, for human safety.

"The last thing we want is some chaotic approach where (people) take things into their own hands," he said. But Almand said there was a big difference, since predator control is done to benefit the livestock industry, which is regulated by the BLM.

"We cannot allow a county board, a state department of agriculture or whatever to initiate predator control on BLM lands and just sit by without ensuring it's done correctly," Almand said. "There's no magic answer." The Fish and Wildlife Service was investigating the incident because disturbing eagles is a violation of federal law. Wildlife officials from Devils Lake, N.D. had interviewed the pilot and the commander of the Grand Forks, N.D. Air Force Base before the investigation was closed, Koerner said.

The Air Force will decide whether to investigate the matter further, Koerner said, though Ford said any further action on the matter was unlikely.
