The question that the public should consider gravely and carefully in the Massie case is not whether the facts in the particular case justify the extraordinary measures taken for personal justice or vengeance, but whether in any case any person or set of persons has the right to assume to themselves the powers and prerogatives of the courts to try and punish offenses on their own initiative. Just how far can we go in permitting persons to take the law in their own hands? And just how7 are we to determine when to countenance this method and when not to? HowT can we be sure that the personal vengeance of an aggrieved individual was perpetrated upon the right person? Just when can we be sure that any individual can be accuser, prosecutor, judge, jury, and executioner all at one time? People have often taken the law in their own hands, and probably with complete justification, but society has invariably made them pay a penalty for this extraordinary privilege. We do not assume to venture judgment in the Massie case with its complicated involvement of racial and political considerations.

It is, after all, only incidental to the much broader question of the preservation of the fundamental principle of the exclusive authority of our organized system of trial and punishment for crimes against society, including crimes against criminals. It is intended to be an occasion for the expression of tribute to all the mothers in the nation, and well do they merit this consideration. And especially may we extend the heartfelt sentiment of love and honor to them in these turbulent times. For economic crises may come and go; wars fought and finished; plagues, disasters and all the troubles that try men's souls, but the countless cares and worries of motherhood go on in good times and bad, without end. Well may we give a thought to the problems of the mother in these days of distress the mothers in millions of homes who must bear the added burdens of unemployment of husbands and sons. It is in days like these that the value of the mothers' work becomes clearer to us, for not only must she perform all her household duties to care for the family with little or no money, but she must also keep the spark of hope for better days alive in the home.

It is the mother of the home that must possess the most courage in facing the overwhelming problems of depression. It is she who makes the greatest sacrifices, and who complains the least in suffering the privations of lower standards of living. No soldier in war-time was ever more heroic. Mothers' Day should be an occasion not only for sending of gifts to our own blessed loved ones, but also for the strengthening of our resolution to make this sick old world a much better place for all mothers to live in and to carry on their work of love and of life. one may say, to borrow the recently coined parody of II. I. Philips, the delicatessen dealers have a word for it boloney. But if you want to see a reasoned argument for publicity of a higher type, read the sketch of Edward L. Bernays, in the current Atlantic Monthly.

Bernays as you may know is the nephew of Freud, of complex fame. And Bernays like Uncle Freud, as the writer points out, works along psychological lines, for the moulding of the public mind, in any direction, whether it be to buy more hair nets or to vote wet or dry, is a problem in psychology. Meet Mr Bernays Bernays, it appears, got into the public relations work, and incidentally, he was the coiner of the phrase "counsellor of public relations," by accident. He was to begin with editor of a medical paper, which when Rich ard Bennett proposed to play "Damaged Goods," came forward outspokenly in support of the play's frankness in dealing with sex problems. Bennett sent for Bernays.

and the whole of his career was metamorphosed from editor to public relations counsellor. At the Chicago Fair Well, maybe they were right in rejecting it, but I abound in ideas and now I am going to make another proposal. There is a World's Fair going to be held in Chicago. I propose that iVestine have some sort of representation at that exposition. There is plenty that might be exhibited.

Palestine oranges, grape fruit, olives, figs, olive oil, myriads of exotic and beautiful Palestine flora, salts from the Dead Sea, exhibits of the handicraft schools maybe some exhibits of Palestine dancing. And right alongside of them, I would put a few of those tin boxes or some receptacles for shekels. I believe it would furnish splendid advertisement and pay for itself. For the fact of the matter seems to be, that Jewish Palestine, as far as I can gather is pretty much of a success, but who knows it? He'll Live Long If you want some good Jewish laughs, there is a whole book of them out now by Harry Hershfield. Here is a sample: "I hate to insult our child, Beatrice, but he is a very dumb boy." "Might'll if we send him to Sunday school, it'll help." After a week's religious schooling, the proud papa quizzed his offspring.

"Now, Samuel, what did the Sunday school teacher teach you?" "He's teaching me Kaddish you know, papa, the prayer for the dead." The father rushed to the phone and called up the tutor. "Phooey, you," yelled. "What's the idea of teaching my son Kaddish? Am I dying or is my wife passing away?" "Don't get excited," answered the other. "You should live so long lill he learns it." Back to the Old Days Well, I see by the New Republic that Lee Himonson, famed designer, declares that the corset is coming back indeed, that it is already back, judging from the corset business, which seems to be the one business making a profit in this depression. Well, if you will pardon a pun that is bracing news.

And with the long skirt back, it seems like the good old days for the ladies. I hope that we men at least get our beer back. We men are entitle 1 to something back. This and That Walter Winchell has had a breakdown, due to overwork and now Louis Sobol is substituting for Winchell on radio and Paul Yavitz on his column. Menorah Journal is out again as quarterly.

Did you know that there i.s in New York a new religious society which takes Spinoza as its major prophet? Helen Woodward, who has just written another opus, and is the wife of William E. Woodward, famed for his biography of Washington is a Jewess and a very charming one. Those secretaries of Justice Brandei.s first, they must be A-l men of Harvard, then they are taken for a year by Judge Mack, then they go for a year to Justice Brandeis. Well, there were at least two books by Jews in that list of 50 best of the year by the American Library Association and one of them is the auto-biography of Emma Goldmann, which shows how the world doth change, when a conservative group commends a work by such a radical. 1 COMMUNICATION Milwaukee, Wis.

ANTON, Corresponoing Secretary. Union of Jewish War Veterans Enters Libel Suit Against Francois Coty Paris. (J.T.A.) A libel suit against Francois Coty, perfume manu- facturer, who is now levelling attacks against the Jews in a series of articles, has been entered by the Jew ish Union of War eterans. The suit was brought on the ground that Coty libelously charged that Jewish labor groups, armed with munitions were being formed in France, under cover of being sports and veterans groups. These groups were waiting only for the proper moment to be transformed into revolutionary units, accoi-ding to M.

Coty. The Jewish Veterans organization formally rejected the allegations charging them with disgraceful accusations aimed to cast doubt upon the honesty and integrity of the Jewish soldiers who fought loyally for France. The only motive for its organization, it stated, is to assist former soldiers, their widows and or- phans. The organization prohibits po litical and religious discussion. MILLIONS LISTEN TO RADIO PROGRAM OF HEBREW UNIV.

Scopus, read: "Palestine is the center of this awakening Near East, and Jerusalem, the holy city, the heart of this land now awakening from its sleep of many' centuries. If there were no university in Jerusalem, I feel it would be important to create one. It is almost a misfortune that one was not created two generations ago. If this were done, perhaps some of the suffering endured by the peoples living here might have been avoided." He said that Arabs and Jews created and share a common culture in Asia and South Africa over a period lasting many centuries and that Islam is derived from Judaism in a large measure. "What could be more natural than that the new University at Jerusalem should devote itself and be concerned with an intensive study of Arabic and Islamic culture? Although the Hebrew University is but seven years old," said Dr.

Magnes, "it may be said that it offers without exaggeration, unequalled opportunities for the investigation of the Islamic and Arabic mind. There is no university in America, in Europe or in the whole Arabic world with similar facilities." Felix M. Warburg Speaks from New York Mr. Warburg, who was the first chairman of the American Advisory Committee, founded on the occasion of the opening of the university in 1925, spoke from New York. "There is a grave danger," said Mr.

Warburg, before the program was switched to London, "that in times like these the needs of cultural and educational institutions will be overlooked. "The Jews have often been designated as the 'People of the Book' and many are the sacrifices that have been made in order to keep alive the torch of learning. Since there has been built up in Palestine a magnificent system of education providing for the training of children from the kindergarten to the public and high schools, agricultural schools and technical schools. At the pinnacle of this edifice stands the Hebrew University with its doors open to all who thirst for knowledge. "It should be a matter of gratification to us," Mr.

Warburg pointed out, "as Americans, to know that the Hebrew University has been largely supported by contributions from this country. It is inspiring to know that in Palestine there is being extended the helping hand of science to all who may need help irrespective of their race or religion." The full choir of Temple Emanu-El of New York, under the direction of Lazare Saminsky, furnished the music for the occasion. The choir was assisted by Moses Rudinov, baritone and soloist, and Joseph Yasser, organist, and gave a program of Hebrew, Arabic and Palestinian songs including "The Heavens and the Earth," by Beethoven, set to Hebrew words by Mr. Rudinov. The international radio broadcast coincided with the dedication ceremonies of the J.

Montague Lamport Botanical Garden, which was opened formally at the time of the broadcast. The Garden, a gift of the Lamport family of New York City, was viewed by visitors from Europe and America present in Palestine for the tourist season. The High Commissioner of Palestine, Sir Arthur Grenfell Wauchope, presided at the ceremonies, and Dr. Judah L. Magnes, Chancellor of the Hebrew University since its dedication in 1925, delivered the chief address.

has had for result that the Lutherans in general have become reactionary. It is therefore quite natural that a large number of Protestant pastors see in Hitlerism, which aims to restore status quo ante, a means to recapture the lost influence of Lutheranism. At a Lutheran convention recently held in Hamburg the hope was expressed that Hitler once he attained power, would restore the Lutheran Church to its "rightful position in the State." A manifesto issued by the Union of "Luther-Deutsche," expressed similar sentiments. In Prussia more than 50 per cent of the Protestant clergy are Hitlerite. Every Sunday banners and flags belonging to the "Sturm-Abteilungen" of the Hitlerite Party are being consecrated.

From hundreds of pulpits Prussian pastors thunder each Sunday against "the Marxist hordes." "Brutgasindel von Versailles" and "Untermenschen im eigenen Volke" are expressions not below the dignity of Berliner temples of worship. The most prominent rostrum in the Evangelical Lutheran Church of Germany, that of the famous dom-Kirche in Berlin, is occupied by an ardent and stormy Hitlerite prelate: Dom-prediger Doehring. In Altenburg a beginning was made with special services for Hitler-Young People. The services were so successful that hundreds of churches have followed the example. A synodal decree forbids the introduction of political subjects into sermons.

But this applies solely to revolutionary doctrines. Hitlerite pastors are never reprimanded, no matter how violent their political tirades against "socialist scum," "Jewish vermin" and "other alien broods who infest the sacred soil of Deutschland." The Synod of North Prussia has come out openly for National Socialism as "the sole means to give Germany back her dignity." Against this stands the attitude of the Catholic Church which in several episcopal gatherings decided to keep the "Hakenkreuz" outside the Church. Up to now the Bishops have taken care that National-Socialism did not even gain a footing among their faithful. Chancellor Bruening a practicing and fervent Catholic (he attended mass every morning during his three day sojourn in Paris last year) has repeatedly referred to the hostile attitude of the Bishops to National-Socialism and he has also declared that "as a Catholic" he could never take seat in a government in which the National-Socialists participated. He made it clear, however, that he was speaking solely on his own behalf and in no way expressed the view of the Catholic Centrist Party, which seems to indicate that the Centrum wishes to keep the road open to negotiation, to say the least.

Several weeks ago the Catholic scholar, Professor Schultz published a pamphlet wherein he advises the Catholic Church to make peace with Hitler. In this pamphlet he denounces the "atheistic tendencies of the Left parties" and he praises the "strong idealism and the mighty faith" of the National-Socialists. It is hinted that the Jews are and always have been the consistent underminers of religion. The well-known conferenciers who are charged with "Duesseldorf-fer Jesuit" lectures which are enjoying quite a vogue throughout the Reich, have also swung over to Na7 tional-Socialism of late. These incidents are generally taken as indications that there is a change coming in the attitude of the Centrum Party.

The Catholic Church, The Hebrew University Broadcast Through the miracle of radio, millions of persons throughout the world became acquainted with the purpose of the Hebrew University in Jerusalem in the international broadcast last Sunday of the program of the celebration of the seventh anniversary of the founding of the institution. It was a most remarkable event, probably the first of its kind ever attempted. It typified the very spirit of the Hebrew University, to assist in the dissemination of knowledge throughout the universe. And what more appropriate medium could be devised to spread the light of knowledge throughout the world than the radio? Vliat a marvelous power this radio is! In one hour the whole civilized world was made acquainted with the fact that such a thing as a Hebrew University exists. Never before has a Jewish message travelled so swiftly and been heard by so vast an audience.

A Jewish message of peace and friendship and culture and humanity delivered by great and honored Jews in America, in England, in Germany, in France, and indirectly in Palestine. All in one hour. Dr. A. S.

Rosenbach and Felix Warburg from New York; Sir Herbert Samuel and James de Rothschild from London; Dr. Oscar Wasserman, from Berlin, Chief Rabbi Israel Levi from Paris, and Dr. Judah L. Magnes by message from Jerusalem. Truly a momentous occasion.

Those who listened in have the rare privilege of being witnesses to one of the most significant events in Jewish history, an event that presages profound changes in the wrorld attitude toward the Jew. "We are living in a time when ideas are rapidly changing," said Sir Herbert Samuel in his message from London. "We are living in an age of transition. But nowhere is the change of things so marked as in the Near East. There live side by side, and intermingled in Palestine, two the Arabs and the Jews, races which together through the dark ages kept alight the port of learning.

I believe these two races have worked together in friendly co-operation to their mutual advantage and to the advantage of Palestine and of the world. The Hebrew University seeks to contribute to that end." And this idea of the inter-racial and inter-national value of a world university wras given to all the peoples of the earth in one hour. That this contribution to the advance of education was made bv an institution only seven years old, writh a faculty of only sixty members and with an enrollment of only two hundred students is no less amazing than the miracle of the international transmission of its message. Perhaps out of that little university on Mt. Scopus may issue forth other messages that may bring humanity to an uncivilized world.

I I Nationalist-Socialist Party in the Catholic Centrum Party and the Hugenberg Nation alists in a quandary as to what course to pursue. All sorts of combinations are being envisaged by the political soothsayers. What may come as a surprise to many in America is that the possibility of an entente between the Hitlerites and the Catholics is openly discussed. It is now felt that the Catholics may be inclined to negotiate with Hitler, and that Hitler, from his side, may formulate a program that will prove acceptable to the Roman Church. This must come as a surprise in view of the fact that Hitler has small success in purely Catholic districts in the national elections recently and that his strength lay rather in the Protestant North and East and more especially in the rigidly Protestant Pomerania and Schleswig-Holstein.

The National-Socialists have now come out openly with the declaration that they neither fight for nor against any specific religious cult. Insofar religion is concerned they leave their adherents absolutely free. That they follow a decidedly anti-Semitic program at the same time, is explained by Herr Hitler's personal pro-nunciamento to-wit that he is fighting the Jews as a "racial element incompatible with and destructive to the Teutonic soul." At the same time the elections have shown that National-Socialism, in a general way leads to a sympathetic alliance with Lutheran Protestantism, simply because it is a national movement. Lutheranism is a much more national-German creed of course than Roman Catholicism, which has its spiritual center beyond the Alps in Rome. And so in Germany today we witness the unusual and disheartening spectacle of a great liberal protes-tant Church making common cause with a narrow nationalism which has the odious program of anti-Semitism inscribed on its banners.

Forty per cent of the Lutheran pastors are either members of the National-Socialist party or they are sympathetic to the economic and political doctrines enunciated by Herr Adolph Hitler. Little is left in the National-Socialist Party of the pure racist ideology which tended in the direction of a reversion to the religious cult of the primitive Teutonic barbarians. For a time Hitler's party participated in the movement initiated by the racist, but not national socialist, General Lu-dendorff, who has gone back to the veneration of Wotan and Freya and other pagan Teutonic gods. At present the former Quarter-Master General of the Imperial Army has converted a village in Bavaria to his religious views. In this village the Pagan cult of the days of Herman and Alaric is being practiced.

But the National-Socialists have nothing to do with this. The sympathy of the National-Socialist Party goes out to the Protestant Lutheran Church which had its origin on German soil. The fact that the Social-Democrats and the Catholic Centrists are allied for the time being in a political coalition directed against Communism and Hitlerism, further serves to delay the arrival of an understanding between the Hitlerites and the Catholics. Politically the Hitlerites movement is anti-Catholic, for the time being, at least. The Catholic Church has seen her position improved in the Reich since 1918.

Protestants, to the contrary, have lost their old hegemony. This The Jewish Calendar The Larger Issue in the Massie Case The freeing of the convicted defendants in the famous Massie case in Hawaii meets with the sentimental approval of the great majority in the nation. It is natural that it should. The crime for which the murdered victim was charged is the most heinous and indefensible in the catalogue of acts of human depravity, and there need be little sympathy shown in the fact that his life was snuffed out. But the manner and method by which justice was meted out to the offender cannot be too greatly applauded or countenanced without a rational consideration of its effect upon our elaborate sjTstem for punishment of crime built up through centuries of experience by organized society.

The very foundation of that system rests upon the principle of justice carried out in a prescribed manner by definite institutions representing the whole of society which assumes absolute authority to punish offenses against the safety of any of its members. Those institutions are the courts. They alone have the authority and the right to try and punish. Nowhere in our legal system is there any provision for the trial and punishment of suspected offenders by aggrieved individuals, no matter how great may be the provocation or how intense may be the feeling of public sympathy with the extralegal act of personal vengeance, regardless even of the extenuating incident of miscarriage of justice through the established court process itself. It is true, of course, that the court svstem is not infallible.

It is a human institution and is susceptible to error, but it has stood the test of time as the only plausible and practical method of protecting society against crime. Any deviation from the court process is extremely dangerous. The public may approve an exception here and there, but these very exceptions are apt to undermine the confidence of the public in the entire legal system altogether. There is the further danger of the establishment of precedent in the extra-legal method of personal trial and punishment. If the act of personal vengeance in one case is to be countenanced, just where is society to draw the line of justification in other and similar cases? It would throw the whole legal system in hopeless confusion, dependent upon the momentary wThim and caprice of the mob.
