She hag been ailing for over a month and last Saturday she underwent a serious major operation at the Santa Monica Hospital. She was right in the midst of production on "Secrets in the Dark'" and shooting will necessarily be held up for over a month. I couldn't help but wonder when I heard that the shooting schedule on "Secrets" had been changed if Mrs. Pauline Leader Brand's threatened law suit might be in strumental in calling off the picture. But at it was stated that they are not worried about Mrs.

Brand's suit because there is no illicit romance nor illegitimate child in the picture. Mrs. Brand claimed her former husband, Mil-len Brand, author of "Outward Room," from which "Secrets in the Dark" was taken, had defamed her character. She said she would sue for $500,000. JOEL McCREA, 'who has been off the screen for six months or longer doing official work for the Government, stars in "Fear" at Paramount.

Joel has been rumored for a dozen different movies, but this one, he says, is official. It's a great break for Gail Russell, the girl in this thriller-diller. When I tell you that "Fear" is the new title on an adaptation of "Her Heart in Her Throat." the Ethel Lina White murder mystery, you may remem ber the story. Miss White, a British writer, authored many of these who-dun-its that have been filmed by Alfred Hitchcock. SEEMS LIKE a long time between flashes on Elena Verdugo, the beautiful Spanish blonde who played the native girl with George Sanders in "The Moon and Sixpence." But this morning Elena pops up with her best break sinc that picture, the femme lead with Boris Karloff in "The Devil's Brood" at Universal, THE MICKEY ROONEY "mys-ter" grows by the hour at Camp Fannin, in Texas. If Mickey isn't there his ghost is, for everybody from the rookies to the general believe they have seen Rooney thereabouts. In fact, it became such a thing that the camp paper came out with a headline story. The only solution is that there must be a Mickey Rooney "double" down there or a reasonable facsimile because" Mickey, himself, most assuredly is in Hollywood. CHATTER IN HOLLYWOOD: Mrs.

Richard Smart, the former Patricia Monteagle, socialite, has decided to fight her husband's divorce suit, filed a few months ago in Honolulu. She has engaged Jerry Ceisler and Theodore Roach, two of southern California's most prominent lawyers, to represent her. She will ask for complete custody of their two small children and a very substantial property settlement. Patricia hasn't heard from Smart since he and his piano player went east five months ago. I talked with Richard over the telephone when I was in New York and, at that time, he said nothing about coming back to his wife and small children, whom he left just a few days before Christmas.

Up to that moment Mrs. Smart had no idea that he was unhappy or had been contemplating any sort of separation. I HEARD ON the Twentieth lot that "The Life of Nijinski," owned by Arthur Murray, hss been purchased by Joseph Schenck for Twentieth. At the time Mrs. Nijinski wrote the biography of her famous dancer" husband and his tragic career tt was a best seller.

The bidding at that time was fast and furious, but finally it was decided that it would be too difficult to film. Twentieth has assigned Nick Castle, dance director, to help write the script. As for a ballet dancer to play Nijinski well, that's another question.
