Serjeant Wit LI MS on a former day had moved for a Rule to spew cause why the Defendant who was the Assignee in the right of Ringers Bristol Mercury disposed of to him by the late Proprietor who is a Bankrupt should not ei ther pay the amount of the consideration or purchase-money fur the same to the Plaintiffs who are Assignees of the Bankrupt' effects or surrender the right to them the said Bankrupt having had no legal power to dispose of the same. it being the property of his creditors. He now moved to make the Rule absolute. Mr. Serjeant BEST in shewing cause' argued.

that the mere title right of a newspaper was not of that tangible species of assets upon winch a Statute of Bankruptcy could attach the value ns it depended almost entirely upon the continuance ot the publication which the Bankrupt could nutdu for himself and was nut bound to do for hiscre ditors and it was worth nothing unless the ta lents of the Editor could be transferred along with the title-right. Therefore any coiuidt ration tin- present Assignee of that title-right might be disposed to allow to the late Proprietor came nut fairly within the claim of the Plaintiffs as Assig glees under the Statute. Mr. Strjeant WILLIAMS on the other haul argues that no principle could Le more firmly established in law or practice than this namely that every disposeaLle right vesting in a debtor. ht- came the property of his creditors to the extent of his debt under a Statute of Bankruptcy Such for instance as the right of action fur debt or damages and even under actions fur recovering double forfeiture of money lost at play.
