has been so heavy and unceasing since the first of the year that the 34500 appropriated for that purpose has been exhausted Health Officer Wood ward forwarded a report to this effect to the Commissioners yesterday In order that the emergency may be properly handled Dr Woodward recom jnended that an order be promulgated authorizing all expenditures during the balance of the year be paid out of the unexpended balance of the 15000 appropriated by the deficiency act of March 3 1901 and In the event of this not being sufficient be asked authority to call upon the general District emergency fund It was shown in a report maue by Auditor Garrison that the unobligated balance to the credit of the appropriation for the pfeention of the spread of contagious diseases at this date as noted by the books of the property clerk is Jl67156 He expresses the opinion that In event this balance should be used before the end of the current fiscal ear and no further deficiency appropriation be made for the purpose by Congress that it would seem competent for the Commissioners to declare an existing emergency and use as much of the present emer gency fund as may be necessary The property clerk of the District to whom the papers were referred has been instructed to report the exhaustion of the balance of the fund when it occurs as provided by the act of March 3 1901 COMMISSIONERS HANDS TIED Owing to Court Ruling They Cannot Proceed with Street Work Complaints to the Commissioners are numerous regarding the torn up condition of streets in the northeast section This Is on account of the injunction against the Commissioners holding that the latter hae not the authority to widen or change streets or grades at their will This restraint was placed on the Commissioners by order of the Court of Appeals in a case brought by the Northeast Washington Citizens Association because of the changing of the width of Fifth street by the Commissioners Johnson of 706 Seventh street northeast in a letter to the Commissioners yesterday called attention to the deplorable condition of Seventh street between Man land avenue and street northeast He declares that the street has been torn up for at least three months Assistant Engineer of the District Fer nando sas that no further action can be taken toward the completion of the Im proement the Commissioners until the question of their right to
