April 19 Special The attorney s of the Southwestern ra Iroad do not apprehend that the courts will hold the company liable for payment of the bonds or the Montgomery and Eufaula railroad. which are endorsed by the Central and Southwestern railroads. One of the attorneys informed The Constitutions corre- sponlent today that he had no rear that the Southwestern would be held responsible. The sentral Issued n5IXXJOOO of Montgomery arnI hufaula bonds the proceeds of which were applied to the purchase of the Montgomery and Eufaula by the Central. But ehoul i the Southwestern be required to pay the bonds. the Southwestern would take pos e- slon of the Montgomery and Eufaula. which property is worth the bonds. The result of the suits that were filed against the Southwestern last Saturday in the I United States court. at Macon on account of us endorsement of Montgomery and Eufaula bonds will be awaltled with Interest. Held In Trust. The average stockholder of the Southwestern railroad and the general public do not fully understand the order passed b\ isociate Justice White. of the supreme court last Saturday In the hearing of the uthnestern case at Washington city. He dire ted that tie receiver of the Central kh ill pay to the Southwestern 151000 rental for the six months ending December 31. 1S9t Twenty-five thousand dollars of this is to be paid out at once in cash the bat- an e SI56UO Is to be paid to the Farmers' Loan and Trust Company. to be held as trustee subject to the further order of the court without prejudice to anybody's rihts This rental of 181000 represents dl due the stockholders of the Southwestern by the Central. and the stockholders do not understand why this money should be held in trust and not distributed among them. The reason Is this It Is de- i rtJ to have this money In c vii on hand In the event the Southwestern is held liable on the tripartite bonds and be applied to the payment in part of this liability. In the event the Southwestern is not held liable the money will be distributed among the stockholders. unless it be applied to tic purchase of rolling stock or devoted to similar uses in ca..e the Southwestern withdraws from the Central and operates a so independent line. The 5000. It is generally understood that the J25 00 alluded to above in the order of Associate Justice White is to be applied to the payment of the fees of the attorneys of the Southwestern road. The attorneys made no spp1icaton to the court for fees. The law. jtrs will be paid by the company by whom thc were engaged.
