It does not seem that the sentiment baa as yet struck Atlanta with quite much fury. The colored citizens In this mOe suburb have determined to boycott the Atlanta Street Railway Company for Its action. The Consolidated does not set to be an object of the negroes' indignation.

The Atlanta Street. Railway Company has assigned certain compartmtri riU In- Us ears for the passengers as the law provides and requires them to conform to the rules or be ejected from the cars. This fact was forcibly illustrated when the- ngro Turner was put oft several weeks ago. and a test case was made In the recorders court. The Decatur nroea claim that under the constitution of the United States.

A precedent has been established and the- law on the subject clearly defined but the question that now arUes Is. will the law be observed hereafter Since the decision of Judge Calhoun In the test case. the negroes have been occupying and seat on the cart. and the law seems not to have affected them in the leat The statute states that It the two races do WI occupy their rs pec- compartments on the ear they are liable to prosecution. The motor- men and conductors are vested with the rsjwer of officers.

Chief Connolly of the local police deportment Is of the opinion that it is not his duty to take any port in thi light. When approached on the subject he stated that he was ready and will- Ing to uphold the law at any and all times but that in this case he had no jurisdiction whatever. He stated that It was the duty of the street car companies to make the proper eats when the law is violated. When salted If he would hold the companies liable If they refused to make such arrests he replied that he. was not exactly clear on that point but he was of the opinion that It came' under the jurisdiction of Sheriff Barnes.

It will probably take another test case to see If the law will be enforced. Sheriff Barnes Talks. There is a decided difference of npl110n among the local officials as to the enforcement of the law. The sheriff stated that he had no Jurisdiction over the cue whatever. and that it was the duty of the police to make all such arrests. He has taken no action BO far toward the enforcement of the law. It La not probable that he will. Judge Calhoun.

The precedent he has established was only the result or the plea of Justification presented by the street car company in putting the negro or the car thereby showing the constitutionality of the act. I do not think. said he.

Of- course. the statute plainly- states that the passengers shall occupy their respective compartments and that they shall be fined If they re fuse to ply with the law. The conductors are also liable for prosecution It they do not compel the passengers to enforce the rules. Now it the duty of the conductors.

As It Is a state law I suppose it is the duty of the grand jury to make tile Indictments. I do not think it cornea under the jurisdiction of Chief Connolly. Another View of the Case. There is no doubt. said a prominent lawyer.

Boys in Valdosta Jail Charged with Theft of Horse and Buggy.

Yalaosft Ga. August 2. before last a horse was stolen from Mr. Macdonald's place in the upper part of the county and during the same night Mr. I.

Solomon of this city. had a buggy stolen from his stable. The horse was traced from Its place above here to the city and then a posse was formed to go In search of the thief. warm trail being got trom the start. The thief was captured this morning in Brooks county.

but not until a load or shot had emptied Into him. It was reported hero that the negro was killed. but a subsequent re port stated that he was very bath- wounded. As soon at he can be moved it he does not die. he will be brought here and lodged In jail.

The thief proved to be II ex-convict from rcRaes camps known to his associates as The Squire. There Is doubt as to whether the negro will live to be removed. Two of the youngest horse thieves that have shown themselves In tills section were Dan Tillman and Joe Cole who stole a. buggy with two horses hitched to It In the heart of the city this. morning.

Mr. Doll Nelson came In from the country and hitched his team to a post near the courthouse. In a few minutes the team was gone. and Investigation developed the fact that it had been driven on by two boys. A search was Instituted and.

about six or seven miles from town the boys were overtaken. Dave Tillman was found tied to a tree and a man landing near him thrashing him to blisters. In driving along- the read the young thief took the buggy whip from Us place- and struck one of the mans children with It. The old man Jerked the youngster from the uuggy and tying him to a tree proceeded to wear him out. The two boys were brought to jail this evening and Dave presented a PtaWe sig t.

The meeting held to take' step cernlllr th plans of the anmusement company as to Piedmont park. which Is of vital Importance to the amusement enterprise and all citizens Interested to the project to make a pleasure park out of the old FieJnum exposition perk. The call for this meeting was published In yesterdays Constitution. It was signed by the committee representing the amjserrxnt company.

The Atlanta Amusement Company bought all the exposition buildings at the auctioneer's sale lat week. That. company's option on these buildings. however expires today if the remaining necessary amount of stock subscriptions to the company la not secured. At the meeting this morning the stockholders of which-there areover 100 will alt be present and win attempt to secure the remaining necessary subscriptions.

It will also donate to the Firth Georgia regiment a hall to he used for an armory. and to the Atlanta.

Turn Vereln Association a hall for gymnastic exercises and a drill hall to the Knights of Pythlas. The company also has privileges granted for conducting a first-class garden. In the auditorium the acoustics will be un paralleled in any entertainment house In Atlanta. This will be used for opera concerts conventions etc. The subscriptions are payable 25 per cent down.

Southern Manufacturers Say They Will Curtail La Announced.

A circular letter was Issued to the southern manufacturers yesterday correct- tag the report that they had not kept up to their agreement to curtail. The letter Is Issued by the governing' board. and is as follows August 1st To Southern Textile Manufacturers An editorial paragraph that recently appeared In The Boston Journal or Commerce regarding the curtailment of production by southern cotton mills has been generally copied by the southern press. The editor of the Boston publIca. thin asserts that although the southern mills have announced their Intention to curtail production.

practically all of. them are running on full time. and will continue to do so. On June 29th the Southern Textile Manufacturers' Association held a speial meeting to discuss the matter of curtailment. This meeting passed a resolution urging all southern manufacturers to curtail production as much II possible.

The mills were requested to say whether they would curtail. and to what extent. Four- tlfths of the mills responded to the Inquiry. Some could not stop operations at all. rtb.

era said they would curtail slightly. Qib- era agreed to. curtail from forty to seventy-five per cent. A few mills announced their Intention to close altogether until market conditions Improved. The average of all mills reporting was thirty and tenth per cent curtailment.
