briefly- Turner sues Ford Motor Co. INDIANAPOLIS (UPI) A lawsuit by former Indiana University basketball star Landon Turner says he was disabled in a car accident because the roof of a car collapsed instead of protecting him. Turner sued the Ford Motor Co. and the Chuck Callahan Ford dealership Monday. He was paralyzed in a rollover accident July 25, 1981, when the car he was driving went off Indiana 46 in Bartholomew county.

Spinal cord damage has confined Turner to a wheel chair. A member of Indiana's NCAA 1980 championship team, Turner missed out on his senior year of basketball at IU. His suit, filed in Marion County Superior Court, charges the 1975 car he was driving was "defectively designed and constructed" because when it overturned onto its roof, the top "totally collapsed and afforded no protection" to him. The suit filed for him by lawyer W. Scott Montross specified no dollar amount for damages but asks that the defendants "fairly and adequately compensate him for his losses." The document said the defendants knew of the alleged defect and did nothing to correct it or warn him of it.

Losses claimed include the cost of medical care and equipment for the rest of his life and compensation he might have received as a professional basketball player. Upshaw: Cases need help, too WASHINGTON (UPI) Without passing judgment on NFL Commissioner Pete Rozelle's decision to suspend four players for cocaine violations, the head of the NFL Players Association Tuesday said drug abuse cases require treatment and discipline by the league commissioner. NFLPA Executive Director Gene Upshaw issued a statement saying: "We believe that the proper approach combines treatment of drug and alcohol addiction with predictable, even-handed discipline by the commissioner. "Any player disciplined has the right to appeal the commissioner's decision. We will be available to any player subject to commissioner discipline to make certain his rights under the collective bargianing agreement are observed and protected." Upshaw was somewhere between California and the nation's capital and not available for comment, the union said.

Upshaw's statement said he had discussed the drug matter with Rozelle. "It is important that any player who is disciplined receive counseling and treatment concurrent with punishment," Upshaw's statement said. Union spokesman Jay Benoit said the union intentionally did not pass judgment on Rozelle's decision Monday to suspend Ross Browner and Pete Johnson of the Cincinnati Bengals, E.J. Junior of the St. Louis Cardinals and Greg Stemrick of the New Orleans Saints through four games of the 1983 regular season.

Court rules in favor of Swanns SAN FRANCISCO (UPI) The state Court of Appeal says awards of $40,000 each to former Pittsburgh Steeler Lynn Swann, his brothers and a cousin arising from a beating they suffered at the hands of San Francisco police are not excessive. The appellate court ruling Monday stemmed from a suit filed by Swann and the others following the 1974 incident in which Swann was beaten the night he was chosen as a first-round draft pick in the National Football League. The court upheld a lower court ruling, saying Swann, his brothers Brian and Calvin and their cousin Michael Henderson were rightly awarded some $40,000 each for physical and emotional injuries suffered at the hands of unidentified San Francisco police. However, the court rejected claims that the two arresting police officers used unnecessary force in subduing the men after their arrest for running a stop sign. Swann retired from football after last season and is a television announcer for ABC Sports on USFL games.

During the early morning hours of Feb. 1, 1974, the three men were celebrating Swarm's success in the NFL draft. Later, Brian Swann drove through a red light after leaving a bar and was pulled over by two officers. A scuffle broke out and both officers were injured before back-up help arrived. The three men claimed they were subject to numerous beatings during the rest of the morning by other police officers apparently avenging their colleagues.
