USA between 1969 and 1975.

The Appellate Division of Superior Court rejected claims by former Republican Sen. Jerome Epstein and his father, Frank, that the convictions should be invalidated under search and seizure provisions of the state and federal constitutions. The three-judge panel ruled that search warrants used to check records of fuel ON FOOD COUPONS! DOES NOT APPLY TO FREE COUPONS, COUPONS FROM OTHER STORES OR ITEMS EXCLUDED BY LAW. The court also rejected the appeal of Solomon Epstein, Jerome Epstein's uncle, who had pleaded guilty to charges of conspiracy and receiving stolen property but was given a suspended prison term and fine. Jerome Epstein was sentenced to a three-to-nlne-year prison term and fined $51,000 for his role in the oil theft. Frank Epstein was sentenced to four-to-12 years' imprisonment and fined $203,000. Jerome and Frank Epstein paid the fines but remained free on bail pending their appeal.

According to court records, the Epsteins ran their fuel oil supply business through three corporations Empire Petroleum Rari-tan Oil Co. and Russo Bros. Fuel Oil Co. The state investigation proved a pattern of theft Involving an Empire tanker with a 165,000 capacity that would be fully loaded from Exxon's dork while shipping records would show only half that amount, the records said. The records show more than 8.6 million gallons were stolen from Exxon.

The Epsteins contended the search warrants were based on Insufficient affidavits, too vaguely worded to pass constitutional muster and improperly executed. "We find no basis for invalidating these convictions under the search and seizure provisions of the state and federal constitution," the Appellate Division said In affirming a lower court decision.
