8 Massillon Independent tog. 22,1974 problem for liquor depart men COLUMBUS (API State liquor officials say a serious problem has developed for the department since Ohio law no longer prohibits the owning or possession of slot machines. State liquor rules still forbid gambling paraphernalia in places holding liquor permits, but officials aren't sure of the legality of permit holders having the devices in the same building but in an area not covered by the permit. "WE ARE PRESENTLY trying to get together a policy concerning the deletion of parts of a premises from the permit," said J. Fred Rose, the liquor department's chief lawyer.

"In the past we've had requests for such action, but they are always handled on an individual basis. "Now that slot machines have come into it, the situation appears to be getting serious to a major degree," Rose said. Under the revised Ohio Criminal Code, slot machines and other games of chance still are illegal when used for profit, but their use for charity and pleasure is permitted. Liquor agents raided an Elks club in Steubenville Aug. 12, confiscated four slot machines and accused the club of violating Its liquor permit.

Club officials said profits from the machines went to charity. Rose said the club now has asked for permission to exclude part of the club from liquor permit coverage. He said the intent is not to serve or allow liquor consumption in the room where slot machines are located. An American Legion post in Chillicothe that was raided by liquor agents last spring was acquitted in court of possessing gambling equipment and operating a gambling house because its profits went to charity. But Rose pointed out that the liquor department rule against gambling is a civil regulation and "not a criminal matter." And Capt.

James Martin, deputy director for enforcement, said the department will continue to crack down on gambling on the premises of permit holders, with the exception of bingo games, which are being tolerated. "We have cited numerous places for pinball, slot machines and the like," Martin said. "What we are trying to do now is put the fire out before it gets well along." scheduled the evidentiary hearing after a conference Wednesday with attorneys for Ray and the state. McRae said Ray will be heavily guarded when he is brought from the state prison in Nashville for the evidentiary hearing. The judge set aside two weeks for the hearing. The U. S.

6th Circuit Court of Appeals ordered the hearing into Ray's claim that he was coerced into pleading guilty in 1969 and was inadequately represented by counsel. Ray is serving a 99-year sentence in the slaying of the civil rights leader. "The family will not move in until mid-November," said William A. Goldman, Homewood's vice president. GOLDMAN SAID the family will be selected by the Ohio Fair Commission, to whom the home is to be given. The family will be part of a test that will be conducted on the home during the next year, said Goldman.

He said that if the experiments are successful, Homewood expects to build commercial models that will cost between $30,000 and $50,000. The solar energy plant was designed by Charles F. Sepsy, a mechanical engineering professor at Ohio State University. Sepsy said water circulating through 37 solar panels on the roof is heated to 200 degrees by the sun. The water is then passed through a coil system where air is heated and blown through conventional ductwork into the living spaces.

"The same 200-degree water is used with another system to cool the house in the Sepsy said. "And it will provid hot water for the kitchen and baths by means of a hea exchanger." Sepsy, who teaches course; in environmental control anc energy conservation, said the solar home can cut fuel bills 7 per cent.
