SUNDAY MORNING, FEBRUARY 14,1993 THE qALVESTON DAILY NEWS 5-A TEXAS Dallas police study tapes DALLAS (AP) Police are studying videotapes of the violence that followed last week's Dallas Cowboys championship celebration in hopes of arresting some of the participants. A nine-member task force has already spent dozens of hours reviewing videos of Tuesday's downtown melees. At least 16 adults and nine juveniles were arrested after 79 offenses. The videotapes, obtained from the public and media, could lead to more arrests, officials say. Motorist slain McKINNEY A heavily armed motorist was killed by police Saturday after he pulled a gun and began firing on two officers who had stopped him following a high speed chase.

One of the officers was struck by several bullets, but was wearing a vest, police said. Scott Oberholtzer, 23, of Princeton, Texas, was killed after shooting Allen police officer Scott White. Oberholtzer had a history of violence and convictions of several crimes outside Texas, police said. More than 150 rounds and ammunition and a Clock 10mm semi-automatic handgun were found in the Mazda KX-7 he was driving, police said. White was reported in serious but stable condition after surgery for gunshot wounds at North Texas Medical Center in McKinney, hospital officials said.

Challenge nixed HOUSTON (AP) Donald Fogo, a Pasadena Democrat who lost to Republican Robert Talton in a Nov. 3 race for the Texas House, has decided not to challenge the results. Fogo had alleged that 278 illegal votes were cast by voters who had not registered to vote, had been dropped from the registration list or did not live in the The race was one of several in which the outcome was switched after officials counted, a slew of write-in votes, most of which were cast for an anti-abortion judicial candidate who lost. "We can see no benefit that would be achieved by requiring the entire House to spend its valuable time in further deliberation of this matter," Fogo's attorney, Thomas Steinmeyer, said. Adoption suit DALLAS (AP) A couple who alleged that a Lubbock adoption agency failed to tell them the health problems of two infants they adopted have been awarded more than $1 million in damages. The settlement between Debra and Chris Burgess of Nacogdpches and Smithlawn Maternity Center was approved Friday by U.S. District Judge Jorge Solis of Dallas.

The parents had accused Smithlawn and three of its officials of lying, withholding information and denying them access to records about their children, Caleb Aaron, 4, and Sarah Suzanne, 5. In the settlement, the agency and its employees admitted no fraudulent acts, but they agreed to pay damages for failing to provide medical information to the parents before the 1988 adoption. Bush deposition being sought in suit involving Libya and Iraq Associated Press HOUSTON Plaintiffs in a lawsuit involving a family whose dealings with Libya and Iraq are under federal investigation want to subpoena former President Bush for a deposition. An application filed in a Houston state court asks that Bush be required to give a deposition in the case of Dr. Ihsan Barbouti, the Houston Chronicle reported Saturday.

The parties filing the application Friday contend Bush is "known to have pertinent and material evidence relevant to the central issues of the lawsuit." Andrew Maner, a spokesman for Bush in Houston where the former president now lives, could not be reached for comment Saturday. State District Judge Eileen O'Neill is expected to hear arguments on the application next week. Federal officials have alleged that Barbouti and his eldest son, Haidar Barbouti, used several companies as fronts to export petroleum technology, with both industrial and military applications, to Libya and Iraq. Barbouti reportedly died in July 1990, but he is alleged to have feigned his death and gone into hiding. Several former business associates have filed lawsuits in three states against Barbouti interests claiming they were defrauded through illegal export schemes.

Last year, a jury in Houston found the Barboutis liable for more than $12 million to Bruce Munden of Dallas and his Pipeline Recovery Systems Inc. The application filed Friday pertains to a lawsuit filed on behalf of Rig Structures Supply Co. and three former Barbouti associates or employees: Arthur J. Valentz, Bob McCurdy and James Olen Groves, all of Houston. The document says there is no intent to embarrass or harass Bush, but the plaintiffs want to question him about several items, including: Any knowledge he may have about "the alleged activities of Ihsan and Haidar Barbouti in procuring materials for atomic and chemical weapons projects in Iraq." Barbouti's alleged attempts in 1988 to arrange a secret meeting between Momamar Gadhafi and then President-elect Bush.

Black Democrats endorse Krueger for Senate race Associated Press AUSTIN The Texas Coalition of Black Democrats Saturday endorsed interim U.S. Sen. Bob Krueger in a May 1 special election for the seat vacated by Lloyd Bentsen. Following speeches by Krueger and former attorney general Jim Mattox, both Democrats, the group voted 64-29 to back Krueger.

Sixty percent was needed to win the endorsement. "People like Mattox and they like Krueger, but they feel that it's better to show some cohesiveness (in the party) by supporting one candidate," said Booker T. Morris, president of the coalition. Earlier, Krueger, who has already received the endorsement of the State Democratic Executive Committee and most other party leaders, urged the coalition to join in backing him. "It's not going to be a snap to win this election.

We have to have a united Democratic Party if we want to keep a Democratic senator from Texas in (Washington)," he said. Krueger also told the group he would be heading up a committee to recommend applicants for 12 federal judge appointments. He asked for suggestions and promised to be "affirmatively active to see that those people who've not been represented on the bench before will be there." Meanwhile, Mattox blasted Krueger's voting record while they both served in Congress in the 1970s, saying they sharply differed on food stamps, jobs and education. Gunman sentenced to death for deadly courtroom spree Associated Press AMARILLO A lawyer was sentenced to death Saturday for killing two attorneys during a rampage in a Fort Worth courtroom last summer that left three other people wounded. A Potter County jury took about an hour Saturday to sentence George Lott, 45, to death by lethal injection.

Lott was convicted of capital murder on Friday. Lott stepped back slightly when state District Judge Sharen Wilson read the verdict. He made no comment, but asked that the jurors be polled individually. He noted the verdict on his yellow notepad as Judge Wilson read it. Lott, who confessed in a television interview, saying he wanted to draw attention to wrongs allegedly done to him by the legal system during his divorce and in a child- molesting charge brought against him by his ex-wife, represented himself during the trial.

In a one-minute closing argument, Lott braced his arm on a podium, stared at the jury panel, then quietly and evenly advised jurors of their duty. "Make your decision so that you can live easy with yourself and God," he said. Prosecutor Alan Levy followed Lott's statement with an impassioned plea to give Lott "a date with the executioner because he deserves it. He's earned it." Levy said Lott was a predator who planned for months to ambush a courtroom and kill people he didn't even know. "Lott radiates hate like a stove radiates heat," Levy said.

Lott summoned no witnesses on his own behalf Saturday. Prosecutors called seven witnesses, including five people who testified Friday about Lott's character. On Saturday, they described Lott as a belligerent and fight-provoking man. "I am 2,000 percent sure that Mr. Lott is a danger," said Fort Worth Judge Maryellen Hicks, who presided over Lott's child custody battle in January 1990.

Lott could have been sentenced to life in prison for killing the lawyers July 1 at the Tarrant County Courthouse. Three other men including two judges were wounded when the gunman began firing inside the 2nd Court of Appeals. Lott surrendered hours later at WFAA-TV studios in Dallas. He was taped admitting he committed the crime because he was angry- at the way the 2nd Court of Appeals had handled his divorce and child custody case. Prosecutors, who are seeking the death penalty, say the shooting was Lott's premeditated way of gaining revenge.

He had pleaded innocent. The trial started Tuesday with graphic descriptions from people inside the courtroom when the shooting broke out. Witnesses told the terror of hiding under benches and hearing the methodical shots nearby.
