The First ftistrlct Court of Appeals Wednesday refused to Issue a writ of mandamus directing the Board of Elections to place the Issue on the ballot.

The opinion, written by Judge C. Watson Hover nd concurred In by Judges Bert Long and Richard H. Hlldebrant, made these points: Certification of the Initiative petitions Involved "was made too late to place the Issue on the ballot for the general election In 1963." In any case, the petitions "did not propose any law for enactment and did not propose anything more than what has already been done by (Norwood) Council Itself." Republican candidates In Norwood collected sufficient signatures on petitions asking that this question be voted upon this fall: "Shall Norwood City Council undertake an urban renewal program which Includes Federal financial assistance?" The Board of Elections refused to place the Issue on the ballot, however, In the belief that certification had occurred too late. Secretary of Stat Ted W. Brown cast the deciding vote In that decision.

The petitioners then requested a court order. Judge Hover wrote that certification "requires something, however Informal, In writing which Is a communication of record to be construed and accepted by the board as a request to place an Issue before the electors." He said a communication Of this sort was not received from Norwood city officials until September 4, after the deadline for submitting Issues In the November election had passed.
